Health Authorities Force Closure of Marbella Clinic of Surgeon Linked to Fatal Liposuction

Health authorities close the Marbella clinic of the surgeon accused of Sara Gómez's death for advertising as a plastic surgeon without qualification.

The Territorial Health Delegation of Málaga has forced cardiovascular surgeon Javier A. M. to cease operations at his clinic in Marbella for advertising himself as a plastic surgeon without being qualified. The doctor is facing charges for negligent homicide following the fatal liposuction of Sara Gómez.

The cardiovascular surgeon who will be tried for the death of Sara Gómez has had to close his clinic in Marbella. The Territorial Health Delegation of Málaga opened a sanctioning file after discovering that he was advertising himself as a plastic surgeon without having the specialty. The doctor has informed the inspection that the Eclat Aesthetic Club has definitively ceased all healthcare activities.

Doctor Javier A. M. confirmed the closure in writing: “Good afternoon, regarding your notification, we inform you that the healthcare centre Eclat Aesthetic Club has definitively ceased all healthcare activities, and is currently not attending to patients.” He also indicated that he has begun the process of removing his social media profiles, although this process is in the hands of third parties.

An Inspection That Started from an Anonymous Email

The inspection of health services acted after receiving an anonymous email alerting them to the doctor's background. The inspector verified that he was not disqualified, but upon analysing the advertising on Facebook, discovered that the doctor identified himself as a “plastic surgeon” without holding the official title of specialist in Plastic, Reconstructive and Aesthetic Surgery.

The sanctioning file from the Junta de Andalucía indicates that there were “indications of improper use of the specialist designation” and “possible professional practice outside the recognised specialty's competential scope.” Health authorities gave him 10 days to inform whether the clinic was still operational, and upon his response, will process the definitive closure of the centre.

The clinic was located on Lagasca Street in San Pedro de Alcántara, Marbella. There, the doctor offered aesthetic surgery services through social media, despite his specialty being cardiovascular surgery. For the local residents, the closure marks the end of an activity that, according to the inspection, posed risks to patients.

Sara's Family Will Take the Case to Prosecutors

Rubén, brother of Sara Gómez, has confirmed that they have submitted the sanctioning file to the Investigating Court 3 of Cartagena, which is investigating the death of the real estate agent. Additionally, he announced that they will report the doctor to the Prosecutor's Office “for advertising himself as a plastic surgeon, as well as for performing and promoting aesthetic surgery treatments without a license, misleading patients and putting lives at risk.”

The doctor is facing charges for homicide due to negligence, along with the anaesthetist who assisted him in the liposuction. The family has appealed for him to also be tried for fraud and deception, having promoted his services without the required specialty. The closure of the Marbella clinic strengthens their argument: the doctor was practising as a plastic surgeon without being qualified.

Sara Gómez died on January 1, 2022, a month after undergoing liposuction at the doctor's clinic in Cartagena. The autopsy determined that the death was a consequence of the complications from the procedure. Since then, her family has been fighting for justice and to ensure no other patient suffers the same fate.

The closure of the centre in Marbella is another step on that path. The Junta de Andalucía acted swiftly following the anonymous complaint, and now the justice system must determine the criminal responsibilities. Meanwhile, the residents of San Pedro de Alcántara will no longer see the sign of Eclat Aesthetic Club, a clinic that, according to the inspection, operated outside the law.
