Andalusia has initiated a process to renew its environmental legislation, the most ambitious of the 21st century. Since 2019, the aim has been to adapt regulations to current and future challenges in sustainability and the environment.
Modernisation of environmental legislation
The Junta de Andalucía is implementing a set of laws that update key regulations and strengthen the protection of natural heritage. This legislative package includes aspects such as the circular economy, environmental management, and forestry policy.
Among the new features is the Andalusia Circular Economy Law (LECA), approved in 2023. This law transforms the production model, prioritising prevention, reuse, and recycling. It also establishes sustainability criteria in areas such as building and urban planning.
The LECA also introduces obligations for adaptations in municipal ordinances and specific measures to reduce food waste. Tax incentives are expected for activities related to repair and reuse, promoting a more responsible use of resources.
New laws on environmental management and protection
The Law for Environmental Management of Andalusia (LEGAM), recently approved, simplifies and reorganises environmental management regulations, creating more agile and clear procedures for processing authorisations. Maximum deadlines are established for resolving environmental permits.
The new legislation also assigns the Junta the responsibility for processing the most complex projects, allowing municipalities to focus on simpler matters. This aims to reduce administrative burdens and improve coordination among different administrations.
Additionally, changes to forestry regulations are introduced through the Andalusia Forest Law (LEMA), which updates regulations to adapt to recent social and environmental changes, promoting sustainable forest management and bioeconomy.
Finally, the Environmental Agents Law has been approved, providing a specific legal framework for this group, improving their organisation and functions, as well as their ongoing training. This ensures greater effectiveness in protecting Andalusia's natural heritage.
