The Ministry of Housing and Territorial Planning suspends the final approval of the regularisation of 26 rural nuclei in the capital and returns the file to the City Council for modification. The procedure, initiated 13 years ago, affects 840 homes that still lack access to basic services such as water or sanitation.
The Ministry of Housing and Territorial Planning of the Junta of Andalucía has decided to suspend the final approval of the file that was to legalise 26 dispersed population nuclei on rural land in Málaga capital, which group 840 homes. The decision, reported by Diario Sur, returns the document to the City Council for modification and re-approval, including public exposure procedures and requests for reports from other administrations.
The procedure began 13 years ago in the Municipal Urban Planning Office. Two years ago, the City Council closed the file and sent it to the Junta, which has the authority to give final approval. It was not until April that the regional administration deemed the documentation complete and correct, after several requests for amendments. Now, the Ministry considers that the project does not meet the requirements and returns it to square one.
The resolution states that the settlement of Los Carneros, with 70 homes, cannot be regularised because "this area is not integrated into the urban mesh", therefore it asks the City Council to adequately justify "its territorial and urban integration" and ensure "the sufficiency of infrastructures, services and basic provisions".
For the other 25 nuclei, the Junta argues that "the delimitation of each of the 25 areas according to the legal concept of dispersed rural habitat is not clearly and detailedly accredited". It also demands justification of compatibility with the protected areas of Los Montes de Málaga and to avoid the "risk of urbanisation", maintaining "the strictly rural character of these nuclei, preventing them from transforming into urban structures".
The report adds that the technical project submitted by the City Council does not include the conditions from the reports of the Delegation of Culture nor the observations from the strategic environmental declaration.
The affected nuclei are distributed between the surroundings of Campanillas and Santa Rosalía Maqueda, to the north of Puerto de la Torre, and the area of Los Montes and the eastern district. In Campanillas are Locota San Antonio (190 homes), Costilla (19), Los Arias (11), El Mallorquín (30), El Ciprés (13), Cortijo del Conde (33), Salinas (33), El Cerrillo (19), Cuesta del Cerrado (112), Casas de Lanza (15) and Matagatos (12), in addition to Los Carneros (70). In Puerto de la Torre are Los Vázquez (22), Los Ruices (8) and El Mirlo (15). And in Los Montes and the easternmost part, Los Negros (22), Molinos de San Telmo (9), Los Pintados (22), Cotrina (21), Valladares (19), Venta El Boticario (12), Venta El Detalle (48), Las Maravillas (18), La Pocaria (15), Las Tres Marías (15) and Altos de Jaboneros (37).
The regularisation would have allowed residents to request the City Council for connection to the supply and sanitation network, or for a mechanism to provide the service from Emasa. With the suspension, thousands of residents will have to continue waiting. The file now returns to the City Council, which must modify the document and repeat the public exposure before resending it to the Junta.
