TSJA confirms 3.5 years in prison for knife attack in Málaga

TSJA upholds the sentence of three and a half years in prison and a €15,000 compensation for a knife attack in Málaga.

The Superior Court of Justice of Andalusia confirms the sentence of three and a half years in prison and a compensation of €15,000 for the perpetrator of the attack, who assaulted the victim with a 14-centimetre kitchen knife after meeting her through social media.

The Superior Court of Justice of Andalusia (TSJA) has upheld the sentence of three and a half years in prison imposed by the Audiencia de Málaga on a man for assaulting another with a 14-centimetre kitchen knife, as reported by Diario Sur. The ruling also includes the payment of €15,000 in compensation to the victim for the injuries sustained.

The proven facts state that the convicted individual contacted the victim through a social network and sent her persistent messages urging her to come down from her home, along with death threats. They later met in the street, where a dispute ensued.

During the altercation, the accused brandished a kitchen knife of approximately 14 centimetres in blade length and attempted to stab her. The victim managed to fend off the attack by grabbing his hand, at which point both fell to the ground. The intervention of third parties allowed the assailant to be disarmed.

Subsequently, according to the ruling, the convicted man punched the victim on the top right side of her head and then kicked her several times in the left eye. As a result, the victim suffered injuries to her face, both to her eye and mouth.

The Audiencia de Málaga convicted the perpetrator of an assault offence to a sentence of three and a half years in prison, in addition to the €15,000 compensation for civil liability, and acquitted him of the threat charge he was facing.

The defence filed an appeal before the TSJA claiming an error in the evaluation of the evidence and a violation of the right to the presumption of innocence. The judges dismissed all the grounds and fully upheld the sentence issued by the Audiencia de Málaga.
