The Association for the Defence of Public Health in Málaga has submitted an extraordinary review resource against the location of the future third hospital, considering that it is situated on the bed of the Arroyo de los Ángeles.
The Association for the Defence of Public Health in Málaga has submitted an extraordinary review resource against the agreement of the Government Council of the Junta de Andalucía dated 2 August 2022 that declared the construction of the third hospital in the capital to be of regional interest. The document, driven alongside the Citizen Platform of Málaga for Public Health and a 21st Century Hospital, questions the chosen plot: the parking lot of the Civil Hospital, located on the bed of the Arroyo de los Ángeles, a flood-prone area.
The resource is supported by a report from civil engineering technician Juan Carlos Mata Soriano, presented this Friday at the Economic Society of Friends of the Country. The document argues that the regional resolution made a factual error by not including the necessary data to assess the flood risk of the land, as stipulated in Article 125.1 of Law 39/2015 on common administrative procedure.

The engineer warns that a hospital infrastructure requires a higher level of protection against flooding than conventional buildings, and recalls that the Hydraulic Public Domain Regulation (approved by Royal Decree 849/1986) prohibits the establishment of hospitals in flood-prone areas unless the absence of alternatives is certified and accessibility in emergencies is guaranteed.

Mata Soriano has also alerted to the temporal overlap between the hospital construction, which began in January 2026, and the metro arrival works. According to his analysis, both excavations will overlap and could cause damage to the buildings on Blas de Lezo Street, affect groundwater and the water table, and even damage the foundations.
Segundo Martín, a representative of the citizen platform, clarified that they do not oppose the hospital itself, but the suitability of the location: “the historical possibility of flooding the land is fundamental.” The resource asks the Junta to reconsider the location before it is too late.
